My quick skim of the summary tells me that this is a lazy piece of legislation that muddies the waters in an area where clarity is already a big issue. For me, it comes down to the question of what constitutes a 'diligent search' as it strikes me that the first assumption one ought to make about an image on a website is that it's owned (or properly licensed) by the person who published it; if that can be established as a fair assumption (and it surely will as soon as the first legal cases are brought) then I don't see any real change to the status quo.
