We are massively struggling to find the answer, if anyone has any idea about this we'd appreciate it.

Our company wants to have a mascot, a toy which we will take photos of for Instagram, use in marketing material, on our website etc. These images will not be sold, but they will be used commercially to promote the company.

Can we buy a toy (the one we have found is TY branded) and take photos of it for this purpose or are there copyright issues with this?

You will need to get permission from the toy creator to use this in branding and marketing material - you may or may not have to pay a fee and/or sign a contract for using the toy.

Thought so, thanks very much. Will have to find someone on etsy willing to give us permission.
