Does this also mean someone can copy your work and pass it off to a client by claiming to have never seen it? I assume you could request an equivalent "cease and desist", but only if you discovered the work was in use.

Suppose to stop things like this happening

Although - you could argue that it's completely up to the responsibility of the designer to research the design before submitting it to a client.


But then of course you have a similar name to a company as long as you aren't in the same business.

And in this case if your name and logo is similar then it's up the person to prove they were there first and the other person should change their logo.
